The Gillette EA SPORTS™ Champions of Gaming North America Tournament ("North America Tournament") begins on or about 12:00:01 a.m. Eastern Time ("ET") October 31, 2008 and ends at 11:59:59 p.m. ET January 11, 2009. Open only to legal residents of Canada, Mexico, Puerto Rico and the fifty United States (except Maryland and Vermont) and District of Columbia. Void in Maryland, Vermont, all other jurisdictions and where prohibited by law. IF YOU ARE NOT A LEGAL RESIDENT OF ONE OF THE ABOVE JURISDICTIONS, DO NOT PROCEED, AS YOU ARE NOT ELIGIBLE FOR THIS CONTEST.
The North America Tournament is a live, skill-based competition in which participants ("Players") compete against other Players on the Xbox LIVE gaming platform to determine winners as described herein. This Tournament will consist of one (1) nine-part Qualification Round and one (1) Knockout Round. The North America Tournament is subdivided into five (5) EA SPORTS Game Titles. Players competing in an individual Participating Game Title will only be competing against other Players in that Game Title and will only be ranked on a Tournament Leaderboard for that Game Title. All five (5) Participating Game Titles will be conducting Tournament Play in accordance with the schedule outlined below. See the "How to Participate in a Qualification Round" section below for game-specific instructions. Players may participate in as many Participating Game Titles as they choose during the Qualification and Knockout Rounds; however an individual Player may only compete in one (1) Participating Game Title in the Global Final (if applicable).
The Qualification Round begins on or about 12:00:01 a.m. ET October 31, 2008 and ends at 11:59:59 p.m. ET December 28, 2008 ("Qualification Period"). Up to the top 10 Players ranked on the Tournament Leaderboard (as defined below) for each Participating Game Title except for NASCAR® 09 (see below) each week (as defined below) are "Qualifiers" and will advance to the Knockout Round for that Game Title. A Player may only be a Qualifier once for each Game Title.

If a Qualifier is ranked in the top 10 on the Tournament Leaderboard in subsequent weeks that Player will not be counted in the top 10 for those subsequent weeks and, for each subsequent week in which a Qualifier is ranked in the top 10, the next highest-ranked Player for that week will advance to the Knockout Round for that Game Title. If a Player does not rank in the top 10 in a week, he/she may continue to compete in subsequent weeks to attempt to rank in the top 10.
The Knockout Round begins on or about 12:00:01 a.m. ET January 4, 2009 and ends at 11:59:59 p.m. ET January 11, 2009 ("Knockout Period"). For each Participating Game Title other than NASCAR® 09, up to 90 Qualifiers will compete against each other. The highest-ranked Player on the Tournament Leaderboard at the end of the Knockout Round will be named the North America Champion (or "Regional Champion") for that Game Title.
For NASCAR® 09, there are no Qualifiers, however, Players must register in-game and complete at least one (1) online match race during the Qualification Round to be eligible to compete in the Knockout Round, regardless of Tournament Leaderboard ranking. The highest-ranked Player on the Tournament Leaderboard at the end of the Knockout Round will be named the North America Champion for NASCAR '09.
The North America Champion for each Participating Game Title (5 in total) will participate in the Gillette Champions of Gaming Global Final Round in Orlando, Florida ("Global Final") against the Europe and Asia Champions for that Game Title to determine the Global Champion for that Game Title. If the same Player is the North America Champion for more than one (1) Game Title, that Player must choose only one (1) of the Participating Game Titles in which to participate in the Global Final; and, the runner-up(s) to the North America Champion for the Game Title(s) that the North America Champion elects NOT to participate in the Global Final will be deemed the North America Champion(s) for the applicable Game Title(s).
Participating Game Titles: The North America Tournament consists of the following five (5) EA SPORTS Game Titles: EA SPORTS FIFA Soccer 09, Tiger Woods PGA TOUR® 09, Madden NFL 09, NASCAR® 09 and NBA LIVE 09 ("Game Title," individually, "Game Titles," collectively).
Eligibility: The North America Tournament is open only to legal residents of Canada, Mexico, Puerto Rico and the fifty (50) United States (except MD and VT) and District of Columbia, 13 years of age or older at time of registration. Parental consent to enter is required if entrant is a minor in his/her jurisdiction of residence. Void in MD, VT and where prohibited by law. Players must have a valid e-mail address, access to a Microsoft Xbox 360™ video game and entertainment system, the EA SPORTS video game in which the Player is competing (see "Participating Game Titles" above), a valid EA Account in good standing, a valid Gold Member Xbox LIVE account, a valid Windows Live™ ID with their Xbox LIVE Gamertag linked and be in good standing on xbox.com and the Xbox LIVE online service. To obtain an Xbox LIVE account, Windows Live ID or Xbox LIVE Gamertag, access www.xbox.comand follow the applicable instructions. To obtain an EA Account, access www.ea.com and follow the applicable instructions.
Employees, officers and directors, their immediate family members (spouse, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of The Procter & Gamble Distributing LLC (the "Sponsor"), Electronic Arts Inc. ("EA" or "EA SPORTS"), Microsoft Corporation, their parents, affiliates, subsidiaries, printers, advertising and promotion agencies and any and all companies associated with the development, distribution or implementation of, or others providing services in connection with this Tournament (collectively, the "Tournament Operators"); The National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC and (collectively, the "NFL Entities"); the National Basketball Association ("NBA"), its member teams, NBA Properties, Inc., and NBA Media Ventures, LLC (collectively, the "NBA Entities") are not eligible to participate.
How to Register: For all Participating Games, each Player must register in-game before competing. Upon the insertion of a Participating Game, while logged on to the Xbox LIVE service, using an Xbox LIVE Gold Account Membership, connect to the EA SPORTS in-game Servers.
Players may also be able to participate in the North America Tournament during the Xbox LIVE Free Weekend 10/31/08 - 11/3/08, however, an Xbox LIVE Gold account will be needed to participate in later rounds.
Select Xbox LIVE from the main menu. If you are asked if you would like to connect to EA Servers, select "Yes." If you have already accepted the EA Terms and Conditions previously, you may automatically be signed in without having to accept them again. If you are creating a new EA Account you must "Accept" the EA Terms and Conditions to connect to any online features for that title.
While connected online in the Xbox LIVE Menu, select the "Champions Event" Menu item. A registration screen will be brought up. Enter your first name, last name, e-mail address, and an optional alternate e-mail address (some of this information may be pre-populated based on the information you submitted when creating your EA Account. Be sure to carefully review all information for accuracy. If any of the information has changed, please update your EA Account information online at www.ea.com) and hit "Submit." A pop-up screen will appear in-game confirming your Registration and you will be allowed to proceed to the Tournament screens. All communication relating to this North America Tournament will be conducted via e-mail. All Players who register agree to be contacted via e-mail for purposes of this Tournament including without limitation the Qualification, Knockout and Global Final Rounds.
Any information collected in relation to this Tournament shall be used only in a manner consistent with the consent given by Players at the time of Registration, with these Official Rules and with the EA Privacy Notice, which can be found at http://legal.ea.com/legal/legal.jsp. All Registration information is collected and maintained in the United States.
Each Player may only compete using a single Gamertag. Players who are found to have competed fraudulently under multiple Gamertags (or otherwise) will be automatically disqualified from this Tournament including without limitation the Qualification, Knockout and Global Final Rounds and may be disqualified from participating in future Xbox, EA SPORTS and/or Gillette Tournaments at the sole discretion of the Sponsor and/or Partners. Sponsor and/or Electronic Arts Inc. and/or Microsoft Corporation may also take further action, which may include civil or criminal prosecution, so as to protect their rights in the event of alleged fraud.
Eligible Players must ensure that the information listed on their Xbox LIVE and EA Accounts, especially e-mail address, is correct and current at all times. Players are solely responsible for keeping their account information up to date for all information pertaining to registration and/or qualifying for the Tournament.
These Official Rules relate to this North America Tournament only, and Players acknowledge that in addition to these Official Rules, the Xbox LIVE Terms of Use, available at www.xboxlive.com, and the EA Terms of Service, available at http://legal.ea.com/legal/legal.jsp, shall apply. In the event of any inconsistency between these Official Rules, the Xbox LIVE Terms of Use and the EA Terms of Service, these Official Rules shall prevail, govern and control.
How to Participate in a Qualification Round: During the Qualification Period, any Player who has completed the in-game Registration may participate in any of the Game Titles' Qualification Round:
Tie-Breaker - For all Game Titles above, in the event of a tie, Players will be ranked based on their standing on the Tournament Leaderboards. The Tournament Leaderboards automatically rank Players based on the following criteria: First, most games played; second, fewest losses; third, most wins; and fourth, lowest Did Not Finish ("DNF") Percent rate.
Tie-Breaker - In the event of a tie, the Tiger Woods PGA TOUR® 09 Tournament Leaderboard will automatically rank the Player who posted the GamerNET score first higher than any subsequent Players achieving the same score.
For all Game Titles, EA will track in-game activities and determine rankings and standings on the Tournament Leaderboards. Individuals will be identified by their Gamertag. For Games other than NASCAR® 09, Weekly Qualifiers will be posted in the Event NEWS AND INFO Menu Item. EA's decisions are final and binding in all respects.
About Leaderboards: Sponsor, EA, Microsoft Corporation and their agencies assume no responsibility or liability for the accuracy, completeness or currency of the information on any Leaderboard at any given time. Sponsor, EA, Microsoft Corporation and their agencies reserve the right at any time, without notice or liability of any kind, to revise, amend or modify the information on any Leaderboard. Sponsor, EA, Microsoft Corporation and their agencies will periodically update Leaderboards at time(s) of their sole choosing and in their sole discretion. For the foregoing reasons, you are cautioned that inclusion of your Gamertag on the final Leaderboard (or any other posted Leaderboard) for any Game Title for any week or round of the Tournament does NOT constitute a representation by Sponsor, EA, Microsoft Corporation and/or their agencies that you have won a prize or qualified for a subsequent round of the Tournament. Sponsor, EA, Microsoft Corporation and/or their agencies are not responsible for incorrect announcements of any kind. REGARDLESS OF THE INFORMATION ON LEADERBOARD(S), YOU ARE NOT A POTENTIAL QUALIFIER OR POTENTIAL PRIZE WINNER UNLESS AND UNTIL YOU HAVE BEEN PERSONALLY NOTIFIED VIA E-MAIL TO SUCH EFFECT BY AN AGENT OF EA SPORTS AND YOU ARE NOT A PRIZE WINNER UNTIL YOUR ELIGIBILITY AND COMPLIANCE WITH THESE OFFICIAL RULES HAS BEEN VERIFIED BY THE SPONSOR AND/OR THE JUDGES.
For EA SPORTS FIFA Soccer 09, Madden NFL 09, NBA LIVE 09 and Tiger Woods PGA TOUR® 09: Up to the 10 highest-ranked Players on the Tournament Leaderboards every week (see schedule above) will move on to participate in that Game Title's Knockout Round. The Tournament Leaderboards reset every week, and Players who have already qualified for the Knockout Round cannot qualify a second time in the same Game Title. In the event there are fewer than 10 Players on a Tournament Leaderboard for a week, then only the Players ranked on that Tournament Leaderboard for that week will qualify for the Knockout Round and any remaining open spots will not be filled. The Knockout Round for that Game Title will then be played with fewer than 90 Players.
After the nine (9) weeks during the Qualification Round, a total of up to 90 Players for each Game Title will qualify to participate in the Knockout Round for that Game Title. Qualifiers will also receive a Qualifier Prize.
Upon Qualification, Qualifiers will receive an e-mail on behalf of EA SPORTS notifying them of their Qualification status, further instructions on participating in the Knockout Round and a request for the Qualifier's mailing address (for prize fulfillment purposes only). E-mails will be sent within one (1) week of each Qualification Week during Weeks 1 through 8 and on or about December 29, 2008 for Week 9.
No Player will be determined a Qualifier or be eligible for a Qualification Prize until his or her eligibility has been confirmed (see "Claiming Prizes" below). In the event a Player cannot be contacted at the primary or alternate (if any) e-mail addresses submitted during registration, declines a prize, or is otherwise deemed ineligible, that Player will be disqualified, will forfeit his/her prize, and the Player with the next-highest ranking for that week (if any) for the applicable Game Title will be selected to participate in the Knockout Round. This process will continue until a Player is verified and his/her eligibility is confirmed, if time allows. In no event will Tournament Operators allow more than 90 Players into the Knockout Round for any Game Title, except NASCAR® 09.
For NASCAR® 09: The highest-ranked eligible Player on the NASCAR® 09 Tournament Leaderboard each week (see schedule above) will receive a Weekly Champion Prize and up to the 9 next-highest-ranked Players will receive a Qualifier Prize. The NASCAR® 09 Tournament Leaderboard will reset every week, and Players who have already received a prize in the Qualification Round cannot receive another prize during the Qualification Round for NASCAR® 09. Limit one (1) Weekly Champion Prize or Qualifier Prize per person/Gamertag. In the event there are fewer than 10 eligible Players ranked on the NASCAR® 09 Tournament Leaderboard for a week, then only the Players ranked on the NASCAR® 09 Tournament Leaderboard for that week will receive a prize and any remaining prizes will not be awarded.
After nine (9) weeks, a total of up to nine (9) Weekly Champion and 81 Qualifier Prizes will be awarded for NASCAR® 09. Weekly Prize Winners will receive an e-mail from EA SPORTS notifying them of their Weekly Prize Winning status and a request for the Player's mailing address (for prize fulfillment purposes only). E-mails will be sent within one (1) week of each Qualification Week during Weeks 1 through 8 and on or about December 29, 2008 for Week 9.
No Player will be eligible for a Weekly Champion or Qualifier Prize until his or her eligibility has been confirmed (see "Claiming Prizes" below). In the event a Player cannot be contacted at the e-mail address submitted during registration, declines a prize, or is otherwise deemed ineligible, that Player will be disqualified, will forfeit his/her prize, and the Player with the next-highest-ranking for that week, if any, will be verified for a prize. In no event will Tournament Operators award more than 9 Weekly Champion Prizes and 81 Qualifier Prizes for NASCAR® 09.
Winning (or not winning) a NASCAR® 09 Weekly Champion or Qualifier Prize will not impact a Player's ability to participate in the NASCAR® 09 Knockout Round. However, a Player must register in-game and complete at least one (1) online match race during the Qualification Round to be eligible to compete in the Knockout Round.
How to Participate in a Knockout Round: During the Knockout Period, Qualifiers (for all games, except NASCAR® 09) may compete in the Game Title in which they qualified using the same game-specific game play process as outlined above for the Qualification Round. In the event of a tie, the same tie-breaker as in the Qualification Round will be applied.
For NASCAR® 09 the Knockout Round is open to all eligible Players, who registered for the North America Tournament and completed a race during the Qualification Round, regardless of performance during the Qualification Round. The determination of the NASCAR® 09 North America Regional Champion will follow the same process as outlined below for all other Game Titles.
In all cases, the same individual (with the same Gamertag) must participate in both the Qualification Round and the Knockout Round. Use of proxies/surrogates is prohibited and constitutes tampering and will result in disqualification.
Player's scores and rankings will be posted to the Tournament Leaderboards based on in-game performance and will be monitored by EA. EA's Tournament Leaderboards will rank all North America Players participating in the Knockout Round. The highest-ranking Player on the individual Game Title's Tournament Leaderboard at the end of the Knockout Period will be the potential North America Champion for that Game Title and will win a Regional Champion Prize Pack (in addition to the Qualifier Prize or Weekly Prize, as applicable). The second-highest-ranked Player on the individual game's Tournament Leaderboard will win a Regional Second Place Prize Pack for that Game Title (in addition to the Qualifier Prize or Weekly Prize, as applicable). The third-highest-ranked Player on the individual game's Tournament Leaderboard will win a Regional Third Place Prize Pack for that Game Title (in addition to the Qualifier Prize or Weekly Prize, as applicable).
No Player will be determined a North America Champion or be eligible for a Regional Champion Prize Pack until his or her eligibility has been verified. In the event a Player cannot be verified, declines a prize, or is otherwise deemed ineligible, that Player will be disqualified, will forfeit his/her Regional Champion Prize Pack, and the next-highest-ranking eligible Player will be named the North America Regional Champion for the applicable Game Title. This verification process will continue until a Player is verified and his/her eligibility is confirmed, time permitting. Second and Third highest-ranked Players will be verified once the North America Champion is confirmed for each Game Title.
Global Final Event: The Global Final Event will be held on or about February 3, 2009 in Orlando, Florida. For each Game Title, except NASCAR® 09, the North America Regional Champion will compete against the Regional Champions for Europe and Asia in a round-robin tournament to determine the Global Champion for each Game Title. For NASCAR® 09, the North America Regional Champion will compete against the Europe Regional Champion in a head-to-head tournament to determine the NASCAR® 09 Global Champion. There will be no Asia Regional Champion for NASCAR® 09. Official Rules for the Global Final Tournament will be provided to the North America Regional Champions prior to the Global Final Event.
Prizes: For each Game Title the following prizes will be awarded:
One (1) Regional Champion Prize Pack per Game Title (5 in total): Invitation for the North America Regional Champion to compete in the Global Final on or about February 3, 2009 in Orlando, Florida, USA, a Gillette Fusion Shave Kit (In Mexico, a Gillette M3 Power razor and cartridges will be provided in lieu of the Gillette Fusion razor and cartridges. All other Shave Kit elements will remain the same.), five (5) EA SPORTS Game Titles (TBD by Sponsor), a 12-Month Xbox LIVE Gold Subscription and 4,000 Microsoft Points (redeemable for the purchase of merchandise on Xbox LIVE and on Zune Marketplace). Trip for Regional Champion and Guest includes round-trip coach-class air transportation for Regional Champion and Guest from a major commercial airport closest to Regional Champion's residence as indicated at time of registration (airport to be chosen by Sponsor in its sole discretion) and Orlando, Florida, 2-nights standard hotel accommodations (double occupancy) and admission for Regional Champion and Guest to the Gillette Champions of Gaming Global Finals Event. Total Approximate Retail Value ("ARV") of each Regional Champion Prize Pack: $8,430US/approx $8,705CAD. Actual value depends on date/time/point of departure/destination, and any difference between the stated ARV and actual value will not be awarded. Regional Champion and Guest are solely responsible for any other expenses not listed in these Official Rules. Regional Champion and Guest must travel on same itinerary and all travel arrangements must be made with Sponsor or Sponsor's agent. Travel subject to availability and must be completed on dates specified by Sponsor or prize will be forfeited and awarded to an alternate winner if time allows. Some restrictions may apply. No cancellation of reservation or transfer of reservation to another date after reservation has been made. Participating in the Global Final has no retail value. If the Global Final is cancelled or postponed for any reason, Sponsor, EA, Microsoft Corporation and their agencies shall have no further obligation to the winner other than to provide the travel portion and merchandise components of the Regional Champion Prize Pack minus the opportunity to compete in the Global Final event. If the Regional Champion is a minor, his/her Guest must be his/her parent or legal guardian. If Regional Champion's Guest is a minor, he/she must be accompanied by his/her parent or legal guardian entirely at his/her own expense if the parent/legal guardian is not the Regional Champion. Regional Champion and Guest are solely responsible for obtaining valid passports, visas and any other travel documents, if necessary. If Regional Champion resides within a 100-mile radius of Orlando, Florida (as determined by Sponsor in its sole discretion), ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for any difference in prize value.
One (1) Regional Second Place Prize Pack per Game Title (5 in total): A Gillette Fusion Shave Kit (In Mexico, a Gillette M3 Power razor and cartridges will be provided in lieu of the Gillette Fusion razor and cartridges. All other Shave Kit elements will remain the same.), two (2) EA SPORTS Game Titles (TBD by Sponsor), a 12-Month Xbox LIVE Gold Subscription and 1,600 Microsoft Points (redeemable for the purchase of merchandise on Xbox LIVE and on Zune Marketplace). ARV: $220US/approx $227CAD, each.
One (1) Regional Third Place Prize Pack per Game Title (5 in total): A Gillette Fusion Shave Kit (In Mexico, a Gillette M3 Power razor and cartridges will be provided in lieu of the Gillette Fusion razor and cartridges. All other Shave Kit elements will remain the same.), the EA SPORTS title "FaceBreaker™" for Xbox 360, a 12-Month Xbox LIVE Gold Subscription and 800 Microsoft Points (redeemable for the purchase of merchandise on Xbox LIVE and on Zune Marketplace). ARV: $150US/approx $155CAD, each.
Up to Nine (9) Weekly Champion Prizes for NASCAR® 09: A Gillette Fusion Razor (in Mexico, a Gillette M3 Power Razor) with cartridge, the EA SPORTS title "FaceBreaker" for Xbox 360 and a 3-month Xbox LIVE Gold Subscription. ARV: $90US/approx $93CAD, each.
Up to Ninety (90) Qualifier Prizes per Game Title (up to Eight-One [81] for NASCAR® 09) (up to 441 in total): a Gillette Fusion Razor (in Mexico, a Gillette M3 Power Razor) with cartridge and a 3-month Xbox LIVE Gold Subscription. ARV: $30US/approx $31CAD, each.
ARV of all prizes available for all Game Titles: $58,040US/approx $60,003CAD.
With respect to all prizes, difference between actual value and stated value will not be awarded. Any applicable tax on prizes is the sole responsibility of the winner. No substitution or transfer of a prize is permitted except at the sole discretion of Sponsor. If a winner cannot or will not accept a prize, or prize/prize notification are returned as unclaimed or undeliverable, prize will be forfeited and awarded to the next-highest ranked Player for the applicable Game Title, if time allows. Unclaimed prizes will not be awarded and Sponsor will not award more prizes than the stated number above. Sponsor reserves the right, at its sole discretion, to substitute a prize/prize component of equal or greater value if entire prize or component of the prize is unavailable for any reason. Any and all guarantees and warranties are subject to the manufacturer's/service provider's terms and conditions, and winners and guests agree to look solely to such manufacturers/service providers for any such warranty or guarantee claim.
Claiming Prizes: EA, or their agent, will attempt to notify Players who rank on the Tournament Leaderboards and are eligible for a Qualifier or Weekly Prize via e-mail within one (1) week after Qualification for Qualification Weeks 1 through 8 and on or about December 28, 2008 for Week 9. EA's agent will attempt to contact Players who rank on the Tournament Leaderboards in the Knockout Round via the same e-mail address the Player was reached at during the Qualification Round on or about January 14, 2009.
Players who have been notified via e-mail must respond via e-mail and/or phone within 48 hours from time e-mail was sent to confirm his or her willingness to participate in the Knockout Round or Global Final, as appropriate. If a Player fails to respond within this timeframe, he or she will be disqualified and the next-highest ranking eligible Player will be contacted, time permitting. Once a Player confirms his or her eligibility to participate in the Global Final, he or she will be contacted by a Gillette representative to arrange travel to Orlando.
Potential Regional Champion Prize Pack winners will be required to execute and return, except where prohibited by law, an Affidavit/Declaration of Eligibility, Release of Liability and Publicity Release ("Release Forms") within 48 hours from the time of attempted delivery, per Sponsor's directions. If a potential Regional Champion Prize Pack winner is a minor in his/her jurisdiction of residence, Release Forms must be executed by his/her parent or legal guardian. Tennessee residents need not submit to Publicity Release. Additionally, Potential Regional Champion Prize Pack winners consent, and agree to confirm such consent in writing, upon Sponsor's request, to a background check, which may include investigation of their employment history, criminal or other arrest or conviction record, and any other factor deemed relevant by Sponsor such that Potential Regional Champion Prize Pack winner will not, in Sponsor's sole discretion, bring Sponsor, its brands or Tournament partners into public disrepute, contempt, scandal, ridicule or otherwise reflect unfavorably on Sponsor and/or Tournament partners. In the event of non-compliance with these Official Rules, if a potential prize winner is deemed ineligible, declines a prize or fails to complete or return Release Forms within the time period specified by the Sponsor, or Release Forms or prize is returned as undeliverable, prize will be forfeited and awarded to the Player with the next-highest ranking for the applicable Game Title, if time allows.
Each Regional Champion's Guest (parent/legal guardian, if Guest is a minor) must execute and return a Release of Liability and, where lawful, a Publicity Release, within two (2) days of winner's attempted notification. Acceptance of prize constitutes winner's permission (parent/legal guardian, if winner is a minor, and winner/parent/legal guardian agrees to confirm this permission in writing) for the Tournament Operators, the NBA Entities and their respective parents, divisions, agents, successors and assigns, to use, copyright, reproduce, display and publish in any media, now known or hereafter developed, including the world wide web, their name, Gamertag, address, photograph, or other likeness, voice or biographical data, for promotional and/or advertising purposes without notice or further compensation, unless legally prohibited. Prizes will be shipped to verified winners within 8 - 10 weeks of verification of eligibility.
Conditions: By participating in the North America Tournament, all Players (parent/legal guardian if Player is a minor in his/her jurisdiction of residence) acknowledge compliance with and agree to be bound by these Official Rules, the EA Terms & Conditions, the Xbox LIVE Terms of Use, the decisions of Sponsor and/or Tournament Operators, which are final and binding in all respects, and all federal, state/provincial, and local laws and regulations.
Tournament Operators reserve the right, at their sole discretion, to disqualify any individual they find to be tampering with the type, process, or operation of the North America Tournament, any related web sites, to be cheating, to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. In the event of a dispute as to a Player's identity, a Player's identity shall be declared to be the authorized account holder of the e-mail address submitted at time of registration. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address in question. Participants may be required to provide Sponsor with proof that the participant is the authorized e-mail account holder of the e-mail address submitted at time of registration. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of this Tournament is a violation of Criminal and Civil Laws. Should such an attempt be made, Sponsor reserves the right to seek damages from any such individual to the fullest extent permitted by applicable law. Any damage made to the web site will be the responsibility of the authorized account holder of the e-mail address submitted at time of registration.
The conduct of this North America Tournament and the interpretation and enforcement of these Official Rules is governed by the laws of the United States. In the event that any dispute arises regarding the North America Tournament, Players (parent/legal guardian if Player is a minor in his/her jurisdiction of residence) agree that the dispute shall be resolved in accordance with the laws of the State of Ohio without regard to conflicts of law/choice of law provisions of any jurisdiction and that such disputes shall be resolved solely within and by the courts of Ohio. All Players (parent/legal guardian if Player is a minor in his/her jurisdiction of residence) agree to the personal jurisdiction of such Ohio courts and waive any right to change of venue, forum non conveniens or any other, like right.
Limitations of Liability: Sponsor, EA and Microsoft Corporation assume no responsibility for undeliverable e-mails resulting from any cause, including any form of active or passive e-mail filtering by a user's Internet Service Provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mails. By participating in this Tournament entrants (parent/legal guardian in the event entrant is a minor in his/her jurisdiction of residence) agree to release and hold harmless the Tournament Operators, the NFL Entities, the NBA Entities, their respective parents, affiliated companies, subsidiaries, printers, advertising and promotion agencies and each of their respective employees, officers, directors, representatives and agents (collectively, the "Releasees") from any and all liability for any injuries, losses or damages of any kind to persons, including death, or property arising in whole or in part, directly or indirectly, from acceptance, use or misuse of a prize, participation, or inability to participate, in Tournament or any Tournament-related activity. Releasees are not responsible for any incorrect or inaccurate information whether caused by web site users or by any of the equipment or programming associated with or utilized in this North America Tournament or by any technical or human error which may occur in the processing of game plays. The Releasees do not assume any responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access which may result in alteration of game plays or game results. The Releasees are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or registration to be received by EA or Player on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including any injury or damage to Player's or to any other person's computer or Xbox console (or information/data contained thereon or therein) related to or resulting from participation in the North America Tournament. Releasees are not responsible for the inability of any Player to access or complete a game due to any technical malfunction or traffic congestion on the Internet or at any web site or combination thereof. The Tournament Operators, in their sole discretion, may require the replaying of any game or round, or declare any of the foregoing null and void by reason of any technical or other system error. If for any reason the North America Tournament is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, or any other causes beyond the control of the Tournament Operators which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this North America Tournament, the Tournament Operators reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the North America Tournament. Without limiting the generality of the foregoing, in the event that the Tournament Operators determine, in their sole discretion, that any individual games within the North America Tournament have been tampered with or that the validity of any games or rounds has been compromised for any reason, it may eliminate that game or round from the North America Tournament and conduct the North America Tournament on the basis of the remaining games or rounds. In the event that any Player is determined by Tournament Operators, in their sole discretion, to be adversely affected in a game or round by any technical or equipment malfunction, Releasees shall have no obligation to such Players, but reserve the right, in their sole discretion, to schedule special games or rounds among any such Players so adversely affected; and, liability of Releasees shall be limited to re-play of the game/round in their sole discretion. If, for any reason, the North America Tournament is not capable or running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, technical failures or any other causes which the Tournament Operators deem could corrupt or affect the administration, security, fairness or proper conduct of this Tournament, Sponsor reserves the right at it sole discretion to cancel, modify, suspend or terminate the Tournament and to determine winners based on the eligible Players ranked on the Tournament Leaderboards prior to the action, or as otherwise may be deemed fair and equitable by Sponsor. Sponsor shall post notice of such action at www.gillette.com in the United States and Canada, www.gillettefusion.pr in Puerto Rico and www.gillettechampions.com.mx in Mexico.
The NFL Entities, the NBA Entities and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees will have no liability or responsibility for any claim arising in connection with participation in this Tournament or any prize awarded.
Releasees shall not be liable to any winner or any other person for failure to supply a prize or any part thereof, by reason of any acts of God; any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entities (whether or not they prove to be valid); equipment failure; terrorist acts; earthquake; fire; flood; war; explosion; unusually severe weather; hurricane; embargo; labor dispute or strike (whether legal or illegal); labor or material shortage; transportation interruption of any kind; work slow-down; civil disturbance; insurrection; riot; or any other cause beyond Sponsor's sole control. Releasees shall not be liable to any winner or any other person for damage to such person's computer or Xbox console or their contents.
